TERMS OF USE FOR CUSTOMER REVIEWS

IMPORTANT: In accordance with articles L.111-7-2, D.111-10, D.111-11 and D.111-12 of the Consumer Code, this page details the terms of collection, control, and publication of customer reviews on sites operated by the company ZEPHYR O.S.C.

These Terms of Use apply to any user submitting a customer review on the website of the company ZEPHYR O.S.C (hereinafter “ZEPHYR”). Users of customer reviews agree to comply with these terms and declare their unconditional acceptance.

Article 1 – Definitions

In these Terms of Use, words or expressions starting with a capital letter shall have the following meanings:

  • “ZEPHYR” : refers to the company ZEPHYR O.S.C, operator of the website and responsible for the collection, moderation, and publication of customer reviews.
  • “Customer Review” : refers to any review written by a user about a product or service marketed by ZEPHYR, after use.
  • “User / Author” : any individual submitting a customer review.
  • “Confirmed Purchase” : label applied when a review is associated with an order actually recorded by ZEPHYR.
  • “Product(s) or Service(s)” : refers to all products and services marketed by ZEPHYR.

Article 2 – Purpose of Customer Reviews

Customer reviews aim to:

  • to allow users to share their experience;
  • to inform internet users in their purchasing decision;
  • to help ZEPHYR improve the quality of its products and services;
  • to enable an exchange between ZEPHYR and its customers.

Article 3 – Collection of Reviews

ZEPHYR provides a free service allowing users to share their experience with purchased products.

3.1 – Terms of Request

Reviews are collected exclusively by solicitation. After each delivered order, an automatic email is sent to the customer a few days after receiving their order, inviting them to submit a review on the purchased product(s). This solicitation is systematic and identical for all customers, without distinction. No spontaneous review submission is possible outside of this solicitation.

3.2 – Required information

To submit a review, the user must obligatorily provide:

  • a first name or pseudonym;
  • a valid email address.

This information is neither visible nor accessible to other internet users.

Each review must include:

  • an overall rating;
  • a comment describing the real usage experience;
  • an indication of the date or duration of use.

The comment must be personal, sincere, and not reproduce third-party content.

3.3 – Who can submit a review?

Users who may submit a review:

  • aged over 15 years;
  • having actually used a product marketed by ZEPHYR.

Article 4 – Compensation

Compensation may be offered in exchange for submitting a review.

When a published review is accompanied by a photo or video, the author receives a voucher worth €10, usable without minimum purchase on the site le-filet-de-camouflage.fr.

Reviews published without photo or video do not give rise to any compensation.

This compensation is the same regardless of the content or rating given by the author. It does not in any way condition the content of the review.

Article 5 – Moderation and control of reviews

5.1 – Control procedure

Reviews are subject to a check before publication. Moderation is carried out both automatically and manually. Reviews cannot under any circumstances be modified by ZEPHYR.

5.2 – Main characteristics of the check

The check takes place at the time of collection and before the publication of reviews. It focuses notably on:

  • the verification of the review's compliance with these terms;
  • the verification of the absence of illegal, offensive, or defamatory content;
  • the verification of the review's consistency with the product concerned;
  • the detection of fraudulent, spam, or duplicate reviews.

5.3 – Moderation timeframe

Moderation takes place within a maximum period of 30 business days after the review is submitted.

5.4 – Reasons for refusal of publication

A review may be refused or unpublished notably if it:

  • does not concern the product or service being evaluated;
  • is clearly false or inconsistent;
  • constitutes spam or a duplicate;
  • contains insulting, defamatory, discriminatory, or illegal statements;
  • contains personal data;
  • presents a conflict of interest;
  • has an advertising or promotional nature.

5.5 – Informing the author in case of refusal

When a review is refused, the author is informed by e-mail, with an indication of the reasons justifying this refusal. The author may be invited to rephrase their review in compliance with these conditions.

Article 6 – Publication and sorting of reviews

6.1 – Sorting

Reviews are sorted by relevance by default. Chronological sorting is among the available sorting criteria.

6.2 – Publication date and date of experience

Each published review displays the date of publication of the review as well as the date of the consumption experience concerned by the review, when this is provided by the author.

6.3 – Publication duration

Published reviews are visible for a maximum period of five (5) years from their publication.

They may be unpublished notably if:

  • the product concerned is no longer marketed;
  • the review becomes clearly outdated;
  • it is found that it does not comply with these conditions or the applicable regulations.

6.4 – Overall rating

The overall rating displayed corresponds to the arithmetic average of the ratings of the reviews published for the same product.

Article 7 – Contact with the author of the review

ZEPHYR has the possibility to contact the consumer who wrote a review via the e-mail address provided when submitting the review, notably to:

  • request clarifications about the described experience;
  • inform the author of a refusal to publish and the reasons for it;
  • respond to a request or complaint made in the review.

Article 8 – Modification of a review by its author

The author of a review cannot directly modify their review once it has been submitted. If they wish to make changes, they must contact customer service by e-mail at serviceclient@le-filet-de-camouflage.fr specifying the desired modifications. The modified review will be subject to a new moderation process.

ZEPHYR cannot under any circumstances modify the content of a review on its own initiative.

Article 9 – Reporting a review

ZEPHYR implements a free feature allowing product and service managers subject to an online review to report doubts about the authenticity of that review, provided the report is justified.

Article 10 – Rights to use reviews

By submitting a review, the author grants ZEPHYR, free of charge and non-exclusively, the right to use, reproduce, display, distribute, and exploit all or part of the review, on any communication medium, for commercial, marketing, and service improvement purposes, for a period of five (5) years.

Article 11 – Responsibilities and personal data

At the time of publication, only the first name or pseudonym is displayed.

Reviews may be retained by ZEPHYR for analysis purposes for a maximum period of five (5) years, then deleted or anonymized.

In accordance with current regulations, ZEPHYR may be required to disclose certain data by judicial or administrative decision.

Article 13 – Modification of terms

ZEPHYR reserves the right to modify these Terms of Use at any time. The applicable terms are those in effect on the date the review is submitted.

  • Article L.111-7-2 relating to information obligations of persons engaged in collecting, moderating, or publishing online reviews;
  • Articles D.111-10, D.111-11, and D.111-12 relating to consumer information procedures on online reviews;
  • Article L.131-4 relating to applicable sanctions.
